PRE-INSPECTION AGREEMENT

Homeinspections.com Platform Agreement

(Florida)

This Pre-Inspection Agreement (“Agreement”) is entered into by and between:

Client: The individual or entity purchasing the inspection services (“Client”)

and

Homeinspections.com , a platform operated by Public Products Inc. (“Platform”),

and

The individually licensed Florida Home Inspector assigned to perform the inspection (“Inspector”).

By purchasing and/or scheduling an inspection through Homeinspections.com, Client agrees to the terms below.

1. Platform Relationship

Homeinspections.com is a technology and marketing platform that facilitates the scheduling, booking, and payment of inspection services.

Homeinspections.com:

  • Does not perform home inspections.
  • Does not supervise, control, or direct the Inspector.
  • Is not responsible for the inspection findings.
  • Is not responsible for the Inspector’s acts, omissions, errors, or negligence.

The inspection services are performed solely by the independently licensed Inspector.

2. Independent Contractor Status

The Inspector:

  • Is an independently licensed Florida Home Inspector.
  • Maintains required licensure and insurance.
  • Is not an employee, agent, or representative of Homeinspections.com.
  • Is solely responsible for the inspection and report.

Client understands and agrees that the Inspector is an independent contractor.

3. Scope of Inspection

The inspection:

  • Is a limited, visual, non-invasive inspection.
  • Is performed in accordance with Florida Standards of Practice and/or InterNACHI/ASHI Standards as selected by the Inspector.
  • Reflects conditions observed at the time of inspection only.
  • Is not technically exhaustive.
  • Is not a warranty or guarantee.

Concealed, latent, or future defects may exist.

4. Limitation of Liability

The inspection report is prepared solely for the Client.

Any claims arising from the inspection, report, findings, or services performed shall be directed solely to the Inspector.

Homeinspections.com , its parent company (Public Products Inc.), affiliates, officers, directors, employees, agents, and representatives shall have no liability for:

  • Errors or omissions in the inspection
  • Inspection findings
  • Failure to discover defects
  • Consequential or incidental damages
  • Repair costs
  • Real estate decisions
  • Insurance decisions

Client expressly agrees to release and hold harmless Homeinspections.com and Public Products Inc. from any and all claims arising out of the inspection services.

5. Limitation of Damages Against Inspector

Client agrees that any liability of the Inspector shall be limited to the fee paid for the inspection, unless otherwise prohibited by Florida law.

6. Third-Party Reliance

The report is prepared for the Client only.

No third party may rely upon the report without the Inspector’s written consent.

7. Dispute Resolution

Any dispute arising out of this Agreement or the inspection shall be resolved as follows:

  • Client must provide written notice to the Inspector within 30 days of discovering the issue.
  • The property must not be altered prior to giving the Inspector an opportunity to re-inspect.
  • Any unresolved dispute shall be submitted to binding arbitration in Sarasota County, Florida.
  • Each party shall bear its own attorney’s fees unless otherwise awarded.

8. Indemnification

Client agrees to indemnify and hold harmless Homeinspections.com, Public Products Inc., and their affiliates from any claims, damages, or expenses arising from:

  • Misuse of the report
  • Unauthorized third-party reliance
  • Alterations to the property before re-inspection
  • Claims arising from inspection services

9. Payment Terms

Payment is due at time of booking unless otherwise agreed.

Failure to pay voids delivery of report.

10. Entire Agreement

This Agreement represents the entire agreement between the parties and supersedes any prior representations.

If any provision is found unenforceable, the remainder shall remain in effect.

11. Acceptance

By booking, paying for, or proceeding with the inspection, Client acknowledges and agrees to all terms herein.

Electronic acceptance is binding.
